The sentencing data available on this webpage covers sentencing outcomes in the Tasmania Supreme Court between January 2001 and December 2014 for the offences listed below.

Sentencing data is recorded on the basis of the most serious offence for which an offender has been sentenced. Where an offender is sentenced for more than one offence or multiple counts of an offence it is the usual practice for Tasmanian courts to impose a global sentence. That means that the sentencing judge imposes one sentence, and does not distinguish the proportion of the sentence attributable to a specific count of offending.

Understanding this data:

  • The data does not include sentencing outcomes other than a custodial term.
  • Calculations of statistical measurements of sentence length (minimum, maximum, median and mean) exclude fully and partly suspended sentences.
  • Reference to Custodial % excludes fully suspended sentences.
  • Tables for a single count describe sentences for a single count of the particular offence that is the subject of the table.
  • Tables for multiple counts include sentences for 2 or more counts of the particular offence (that is the subject of the table) where it is the principal or most serious offence, and 1 or more counts of a less serious offence.
  • Tables for single and multiple counts describe sentences for single and multiple counts of the particular offence (that is the subject of the table) combined.

  • Acquiring a financial advantage

  • Aggravated armed robbery

    The following tables provide data on sentencing outcomes for the offence of aggravated armed robbery in the Supreme Court of Tasmania between January 2001 and December 2014. The offence of aggravated armed robbery appears in s 240(4) of the Criminal Code (Tas). A person commits aggravated armed robbery if at the time of committing aggravated robbery they are armed with a firearm or other dangerous or offensive weapon or instrument.

  • Aggravated assault

    The following tables provide data on sentencing outcomes for the offence of aggravated assault in the Supreme Court of Tasmania between January 2001 and December 2014. The offence of aggravated assault appears in s 183 of the Criminal Code (Tas). A person commits aggravated assault if they assault any person with intent to commit a crime, or to resist or prevent the lawful apprehension or detainer of himself or of any other person or resists, or wilfully obstructs any person in the lawful execution of any process against any lands or goods. Section115 of the Firearms Act 1996 (Tas) also provides that a person is guilty of an offence under s 183 of the Code if, during the course of an assault, the person uses, threatens to use or carries a firearm.   • Aggravated burglary

    The following tables provide data on sentencing outcomes for the offence of aggravated burglary in the Supreme Court of Tasmania between January 2001 and December 2014. The offence of aggravated burglary appears in s 245 of the Criminal Code (Tas). A person commits aggravated burglary if they commit burglary carrying an offensive weapon, or they burgle a place ordinarily used for human habitation or if they offer violence to or assault any person in the course of the burglary.

  • Aggravated robbery

  • Aggravated sexual assault

    The following tables provide data on sentencing outcomes for the offence of aggravated sexual assault in the Supreme Court of Tasmania between January 2001 and December 2014. The offence of aggravated sexual assault appears in s 127A of the Criminal Code (Tas). A person commits aggravated sexual assault if they unlawfully and indecently assault another person by the penetration to the least degree of the vagina, genitalia or anus of that other person or by a part of the body other than the penis or by an inanimate object.   • Armed robbery

The offence of armed robbery appears in s 240(3) of the Criminal Code (Tas). A person who commits a robbery armed with a firearm or other dangerous or offensive weapon or instrument commits armed robbery.   • Arson

    The following tables provide data on sentencing outcomes for the offence of arson in the Supreme Court of Tasmania between January 2001 and December 2014. The offence of arson appears in s 268 of the Criminal Code (Tas). Any person who unlawfully sets fire to any building, erection, or structure whatever, whether completed or not, or to any stack or heap of cultivated vegetable produce, or of timber, or of mineral or vegetable fuel, or to any mine, or to any ship or vessel, whether completed or not commits arson.
